Customer Licensing, Payments & Commercial Terms
Eleven One Media LLC · Qatar Financial Centre Registration No. 4312 · Doha, State of Qatar
Version 1.0 · 2 September 2026
Purpose
These terms govern the purchase, licensing, access and use of photographs, video, editorial material and related media content supplied by Eleven One Media, including online transactions and account-based commercial arrangements. They are designed to work together with the Licence Information, Terms & Conditions, Privacy Policy and applicable order or invoice.
1. Parties and Scope
These Customer Licensing, Payments & Commercial Terms (the “Commercial Terms”) apply to any person or organisation that purchases, licenses, downloads, accesses or otherwise obtains content or services from Eleven One Media LLC (“Eleven One Media”, “we”, “us” or “our”).
Eleven One Media LLC is a limited liability company incorporated and registered in the Qatar Financial Centre (QFC), Doha, State of Qatar, QFC Registration No. 4312, represented by its Founder and Chief Executive Officer, Mr. Redha Hosni Seggani.
These Commercial Terms apply to transactions made through elevenone.media, any Eleven One Media platform, direct sales, invoices, enterprise accounts, APIs or other authorised channels. Mandatory rights granted by applicable consumer law are not excluded.
2. Contract Formation and Electronic Orders
A binding contract is formed when Eleven One Media accepts an order, confirms a licence, issues an invoice or otherwise provides access to the licensed content, depending on the sales channel. For online orders, clicking an acceptance box, placing an order, making payment or beginning an authorised download may constitute electronic acceptance.
Before an online order is placed, the customer should be provided with the essential characteristics of the content or service, the applicable price, payment arrangements, licence scope, cancellation information where applicable, and the identity/contact information of Eleven One Media. These requirements are intended to operate consistently with applicable electronic-commerce requirements, including mandatory rules that cannot be waived.
3. Licence Grant
Subject to full payment and compliance with these Commercial Terms, Eleven One Media grants the customer a limited, non-exclusive, non-transferable and non-sublicensable right to use the selected content only within the scope stated in the applicable licence, order confirmation, invoice, rate card or enterprise agreement.
A licence is a permission to use content. It does not transfer copyright ownership or any other intellectual-property ownership unless an authorised written agreement expressly states otherwise.
3.1 Licence categories
| Licence | Typical purpose | Key principle |
|---|---|---|
| Editorial | News, reporting, commentary, education and public-interest publishing | Use must remain editorial and contextual; it must not imply endorsement. |
| Commercial | Advertising, promotion, branded campaigns or other commercial exploitation | Only where the content is expressly cleared/licensed for that purpose and required third-party permissions are available. |
| Custom / Extended | High-volume, archival, syndication, API, enterprise or specially negotiated uses | Scope is defined by the specific written order, contract or enterprise terms. |
4. Permitted Use and Restrictions
The customer may use content only for the purpose, media, territory, duration, audience, placement and volume authorised by the licence. Any use outside that scope requires a new or extended licence.
- No resale, redistribution, file-sharing, sublicensing, transfer or provision of the original high-resolution file to an unauthorised third party.
- No use as a logo, trademark, service mark or other source identifier unless expressly agreed in writing.
- No misleading, defamatory, unlawful, discriminatory, pornographic or deceptive use, and no use that falsely suggests endorsement, sponsorship or affiliation.
- No use for training, fine-tuning, benchmarking or building generative-AI or machine-learning systems, datasets or models unless Eleven One Media expressly authorises that use in writing.
- No removal of copyright notices, credits, metadata or technical rights-management information where the licence requires them to remain.
- No material alteration of editorial content that changes the truth, context, meaning or documentary integrity of the scene.
5. Editorial Content, Releases and Third-Party Rights
Editorial content may depict public figures, private individuals, events, trademarks, artworks, buildings, venues or other third-party rights. Availability on the platform does not mean that model releases, property releases, trademark permissions or other permissions have been obtained for commercial use.
The customer is responsible for determining whether its intended use requires additional releases, permissions, clearances or legal review. Eleven One Media may provide available release information but does not warrant that every depicted right has been cleared for every possible use.
6. Credits and Attribution
Where a credit line is required by the licence, editorial practice or accompanying metadata, the customer must reproduce it accurately and in a reasonably visible manner. A typical credit may identify the photographer or contributor and Eleven One Media. Exact wording may vary by content or partner source.
Failure to provide a required credit may constitute a licence breach and may result in an additional fee, corrective credit requirement or other remedy permitted by the applicable agreement and law.
7. Prices, Taxes and Currency
Prices may be displayed online, quoted by the sales team, set by a rate card or negotiated under an enterprise agreement. The applicable price is the price confirmed for the relevant order or licence at the time of purchase, subject to correction of obvious pricing errors before fulfilment where legally permitted.
Unless expressly stated otherwise, taxes, duties, withholding, bank fees, payment-provider charges or similar governmental or transaction charges are not included and remain payable by the party legally responsible for them. Customers must provide accurate billing and tax information.
Eleven One Media may offer prices in Qatari riyals, US dollars or other supported currencies. Currency conversion and card-provider fees imposed by a bank or payment service are not controlled by Eleven One Media.
8. Payment and Invoicing
Payment is due at the time stated during checkout, on the invoice or in the applicable enterprise agreement. Eleven One Media may use authorised third-party payment providers and does not require customers to provide payment-card credentials directly to contributors or photographers.
- Prepaid or online purchases must be successfully authorised before content access may be enabled.
- Approved business accounts may receive invoice terms. Late payment may result in suspension of download or licensing privileges and any lawful collection costs or late charges stated in the invoice or enterprise agreement.
- An invoice, receipt or electronic confirmation may be issued and retained electronically. Customers should keep a copy for their records.
- Payment does not expand the licence beyond the expressly purchased rights.
9. Delivery, Downloads and Access
Digital content is normally delivered by download, account access, API, secure transfer or another electronic method. Access may be limited by account permissions, download limits, technical security controls or licence conditions.
The customer must promptly report failed delivery, corrupted files or incorrect files. Eleven One Media may satisfy its obligation by restoring access, replacing the affected file or providing the ordered content through another reasonable delivery method.
10. Cancellation, Refunds and Digital Content
Refund and cancellation rights depend on the type of customer, the transaction, whether digital performance has begun, whether the customer has downloaded or used the content, and any mandatory law applicable to the transaction.
For transactions subject to Qatar’s electronic-commerce consumer rules, mandatory cancellation or refund rights are preserved. As a general principle under those rules, a consumer may have a limited right to rescind an electronically concluded contract within three days where the service has not been fully performed and the consumer has not received or used the benefit or value. Once licensed digital content has been delivered, downloaded, accessed or used and the service has been fully performed, cancellation or refund may no longer be available to the extent permitted by applicable law.
Eleven One Media may nevertheless issue a refund, credit or replacement in appropriate cases, including duplicate charges, technical delivery failure, materially incorrect content supplied in error, or another verified billing error.
10.1 Normally non-refundable situations
- Change of mind after the licensed file has been downloaded, accessed or used, where law permits.
- Failure by the customer to obtain a third-party clearance that was not included in the licence.
- Use outside the purchased scope followed by a request to cancel the original licence.
- Loss caused by customer-side systems, account sharing or unauthorised internal distribution.
Nothing in this section limits a mandatory right to refund, termination or other remedy that cannot lawfully be waived.
11. Chargebacks, Payment Disputes and Fraud
Customers should contact Eleven One Media before initiating a payment dispute so that billing errors can be investigated. A chargeback does not automatically cancel a licence or resolve a contractual dispute.
Where a payment is reversed, cancelled, fraudulent or successfully charged back and no valid payment remains for the licence, Eleven One Media may suspend the relevant licence or account, require the customer to cease use and remove the content, and pursue lawful recovery. This does not affect legitimate consumer dispute rights.
12. Customer Accounts and Organisational Use
Account credentials are personal to the authorised user unless an enterprise arrangement provides shared or multi-user access. The customer is responsible for activity carried out through its account and must promptly notify Eleven One Media of suspected unauthorised access.
An employee or contractor purchasing for an organisation confirms that they have authority to bind that organisation. A licence issued to an organisation may be used only by the permitted users and business units stated in the applicable agreement.
13. Content Availability, Corrections and Withdrawal
Eleven One Media may correct captions, metadata, credits, pricing or other information and may remove or restrict content when necessary for legal, editorial, rights-management, safety or contractual reasons.
If content is withdrawn after licensing, Eleven One Media may notify the customer and, where reasonably necessary, require future use to stop. Remedies, if any, will depend on the reason for withdrawal, the licence and applicable law. Historic uses made lawfully before withdrawal are not automatically unlawful unless the relevant notice or law requires otherwise.
14. Intellectual Property and Ownership
All copyright and related rights remain with Eleven One Media, the relevant contributor, partner agency or other identified rights holder, except where an authorised written transfer expressly provides otherwise. The customer acquires only the contractual usage rights granted by the licence.
Unauthorised use, copying, scraping, extraction, redistribution or exploitation of content may result in suspension, retroactive licensing charges, claims for damages, injunctive relief or other remedies available under applicable law.
15. Customer Warranties
The customer represents and warrants that it will use the content lawfully, within the purchased licence, and in a manner that does not knowingly infringe third-party rights or misrepresent the subject matter. The customer is responsible for its own publication context, headlines, accompanying copy, advertising claims and downstream distribution.
16. Eleven One Media Warranties and Disclaimer
Eleven One Media warrants that it has authority to grant the licence rights expressly stated for the content, subject to any source, partner or contributor limitations disclosed with that content. Except for express warranties and rights that cannot legally be excluded, content and services are provided on an “as available” basis.
Eleven One Media does not warrant that every item is suitable for every intended use, that every depicted third-party right is cleared for commercial exploitation, or that online access will be uninterrupted at all times.
17. Liability
To the maximum extent permitted by applicable law, Eleven One Media is not liable for indirect, incidental, special, punitive or consequential losses arising from an unauthorised or out-of-scope use, customer publication decisions, third-party rights not included in the licence, or events outside reasonable control.
Any contractual limitation of liability is subject to mandatory law and does not exclude liability that cannot lawfully be limited or excluded. Enterprise agreements may contain specific liability caps or indemnities that take priority for those transactions.
18. Indemnity for Business Customers
Where the customer is acting for business or professional purposes, the customer agrees, to the extent permitted by applicable law, to defend and indemnify Eleven One Media against third-party claims, losses and reasonable costs resulting from the customer’s unauthorised, unlawful or out-of-scope use of licensed content, except to the extent caused by Eleven One Media’s own breach of an express warranty.
19. Infringement and Rights Complaints
Customers who receive a copyright, privacy, personality-right, trademark or other rights complaint concerning licensed content should promptly notify Eleven One Media and provide the relevant publication, licence/order reference and complaint details. Customers must not admit liability on behalf of Eleven One Media or alter evidence relevant to the complaint.
Rights complaints are handled in coordination with the Content, Copyright & Editorial Policy and any applicable partner or contributor agreement.
20. Suspension and Termination
Eleven One Media may suspend access, downloads or licensing privileges for material breach, non-payment, suspected fraud, credential misuse, systematic scraping, repeated copyright violations, security risk or unlawful activity. Where appropriate, Eleven One Media will provide notice and an opportunity to cure before termination, unless immediate action is reasonably required.
Termination does not erase payment obligations or liabilities already accrued. The continued validity of previously paid licences after account termination depends on the reason for termination and the applicable licence terms.
21. Sanctions, Export Controls and Restricted Transactions
Customers must not use Eleven One Media services in violation of applicable sanctions, export controls, anti-money-laundering requirements or other mandatory restrictions. Eleven One Media may decline or suspend a transaction where required by law, a competent authority or a payment provider’s lawful compliance obligations.
22. Governing Law and Disputes
Eleven One Media LLC is incorporated in the Qatar Financial Centre. Unless an applicable order, enterprise agreement or mandatory law provides otherwise, these Commercial Terms and contracts entered into by Eleven One Media LLC are governed by the applicable laws and regulations of the Qatar Financial Centre.
Subject to mandatory consumer jurisdiction rights and any valid written dispute-resolution agreement, disputes may be submitted to the competent Qatar International Court and Dispute Resolution Centre forum where jurisdiction exists. Customers located in another jurisdiction retain any mandatory rights that cannot legally be displaced by a contractual choice of law or forum.
23. Relationship with Other Eleven One Media Documents
These Commercial Terms operate together with the following documents, as applicable:
- Legal Notice
- Terms & Conditions
- Licence Information
- Privacy Policy
- Privacy Settings & Cookie Policy
- Content, Copyright & Editorial Policy
- Any order confirmation, invoice, rate card, enterprise agreement or separately signed licence.
If there is a conflict, a specifically negotiated and signed enterprise agreement or order takes priority for that transaction, followed by the specific licence/order terms, these Commercial Terms, and then the general website Terms & Conditions, unless mandatory law requires a different result.
24. Changes to These Commercial Terms
Eleven One Media may update these Commercial Terms to reflect legal, regulatory, operational or commercial changes. The version applicable to a completed order will generally be the version accepted or incorporated into that order, unless a later change must apply by law or the parties expressly agree otherwise.
25. Contact and Commercial Support
Questions about licensing, invoices, refunds, rights clearance or commercial accounts should be directed through the official contact channels published on elevenone.media. Customers should include the relevant order, invoice or licence reference when contacting the company.
